Service and Website Terms of Use
These Terms govern access to sativa.com.tr, use of its booking system and the digital services provided by Sativa Tour & Travel.

2. Purpose and Scope
These Terms govern access to and use of sativa.com.tr, including browsing tourism services, creating an account, submitting booking requests and using related digital facilities.
Nothing in these Terms excludes or restricts mandatory consumer rights which cannot lawfully be waived.
3. Eligibility and Permitted Use
The Website may be used only for lawful travel research, account management and genuine booking activity. A User must have legal capacity or act under the supervision and approval of a legal representative.
A User booking for another participant must be authorised to provide the required information and must inform that participant of the relevant booking and data-processing conditions.
4. Booking System
- Identity, contact, participant and travel information must be accurate and complete.
- A booking is not confirmed until payment is completed and confirmation is issued by the system.
- Bank-transfer/EFT payment or a valid payment notification must be completed within one hour of booking creation.
- An incomplete bank-transfer booking may be cancelled automatically after that period.
- Service dates, inclusions, exclusions and special conditions are displayed before payment.
Any evident system, content or pricing error will be handled fairly, taking account of its nature, the User’s legitimate expectations and mandatory consumer law.
5. Accounts and Security
Where an account is created, the User is responsible for keeping credentials confidential, using accurate account information, signing out on shared devices and promptly reporting suspected unauthorised access.

6. User Obligations
- Provide accurate and lawful information.
- Obtain required identity documents, passports, visas and permits.
- Disclose relevant health, mobility or accessibility requirements before booking.
- Arrive at the meeting point on time and comply with safety instructions.
- Respect the safety, comfort and rights of other participants.
- Use the Website and booking system in accordance with law and good faith.
7. Prohibited Conduct
- Using false identities, unauthorised cards or bank accounts;
- Introducing malicious software or attempting unauthorised access;
- Manipulating prices, availability, bookings or payment mechanisms;
- Using bots, scrapers or automated extraction tools without permission;
- Copying or commercially republishing Website content without authorisation;
- Infringing privacy, personality, copyright, trademark or other third-party rights.
The Company may investigate reasonable and documented indications of fraud, security threats or unlawful conduct and may take proportionate protective action. Mandatory consumer rights remain unaffected.
8. Prices and Payment
The total price, currency, applicable taxes, discounts and any additional charge are displayed before the booking is submitted. No additional amount is charged without the User’s express prior approval.

9. Principal Booking Rules
The transaction-specific Booking Conditions, Tour Participation Conditions and Distance Sales Agreement prevail for an individual booking.
10. Intellectual Property
All trademarks, logos, designs, software, text, photographs, videos, graphics, tour programmes and databases on the Website belong to the Company or their respective rights holders.
Users receive only a limited, non-transferable right to use the Website for lawful personal purposes. Content may not be copied, altered, commercially exploited or republished without written authorisation, except where use is expressly permitted by law.
11. Third-Party Services
The Website may connect to hotels, carriers, boat operators, payment institutions, mapping services or other third parties. Independent third-party websites and data-processing activities are governed by their own terms.
This provision does not remove any responsibility the Company has assumed under a booking contract or mandatory Turkish consumer law.
12. Availability and Technical Maintenance
Access may be temporarily restricted for security, maintenance, updates, infrastructure failures, official decisions or technical events beyond the Company’s reasonable control.
A payment or booking interrupted before visible confirmation should be verified through the booking record or directly with the Company before a second payment is attempted.
13. Personal Data and Cookies
Personal data is processed under Turkish Law No. 6698 for Website security, account management, booking, contract performance, payment, customer support, accounting and legal compliance.

14. Scope of Responsibility
The Company provides its services with professional care and in accordance with applicable law. Liability arising from intent, gross negligence, personal injury, defective service, non-performance or mandatory consumer law is not excluded by these Terms.
The User remains responsible for consequences attributable to false information, missing travel documents, failure to attend on time or breach of safety instructions.
15. Amendments
These Terms may be updated to reflect legal, operational or technical changes. The current version and effective date are published on the Website.
Amendments are not applied retroactively to the detriment of completed consumer bookings. Material changes are notified through an appropriate channel where required.

Consumers may apply to the competent Turkish Consumer Arbitration Committee or Consumer Court according to the monetary and venue rules in force. Mandatory mediation and other procedural requirements remain reserved.
17. Governing Version and Entry into Force
These Terms enter into force on 18 August 2026. The Turkish version governs transactions subject to Turkish law. This English version is provided for information and accessibility.
A paid booking requires separate presentation and confirmation of the transaction-specific Pre-Information Form, Distance Sales Agreement, booking summary and mandatory acknowledgements.
